IV. Punishments for Overseas Koreans and Non-Korean Citizens who Violate Election Laws

Restrictions on issueing a passport to a person who violates election laws overseas and ordering its return (Public Official Election Act, Article 218-30)
  • Persons who may receive restrictions
    • A person of whom there is considerable reason to believe that they have committed a violation overseas that is subject to a long-term sentence of three years or more under the Public Election Act, but does not respond to the National Election Commission's investigation or whose whereabouts are not clear so that the investigation caanot be closed.
    • A person who has received a suspended sentence for committing a violation overseas that is subject to a long term sentence of three years or more under the Public Election Act.
  • Period of restrictions
    • Within five years of the election day of the relevant election (April 16, 2020 - April 15, 2025)
    Examples of violations

    Jane Doe ordered about 20 members of their organizations to distribute about 1,000 copies of printed materials to Korean residential areas that opposes certain political parties and candidates. Result: charged, issued with a restriction on renewing their passport

Ban on entry into Korea for non-Korean citizen who have violated the Public Official Election Act (Public Official Election Act, Article 218-31)
  • Persons who may receive a ban on entry into Korea
    • A non-Korean citizen of whom there is considerable reason to believe that they have committed a violation of the Public Official Election Act
  • Period of a ban on entry into Korea
    • For the term of office of the candidate elected in the relevent election (until May 29, 2024)
      ※ Excludes when entering the country to comply with the investigation
